The Platform integrates with the WhatsApp Business Platform using Meta's official WhatsApp Cloud API to enable eligible businesses to:

• Deliver customer support messages
• Send Meta-approved message templates
• Automate customer communication workflows
• Manage WhatsApp conversations
• Integrate WhatsApp messaging with CRM processes
Edsans Reach is an independent software platform and is not affiliated with, endorsed by, sponsored by, or operated by Meta Platforms, Inc.
3. User Responsibilities
By using Edsans Reach, you agree to:
Compliance with Meta Policies
Comply with all applicable:
• WhatsApp Business Messaging Policy
• WhatsApp Commerce Policy
• Meta Platform Terms
• Applicable privacy and data protection laws
Customer Consent
You are solely responsible for obtaining valid consent from recipients before sending WhatsApp messages through the Platform.
You must ensure recipients have explicitly opted in to receive communications from your organization.
Prohibited Activities
You agree not to:
• Send unsolicited or spam messages
• Send misleading, fraudulent, or deceptive communications
• Promote illegal products or services
• Violate intellectual property rights
• Harass or abuse recipients
• Circumvent Meta's messaging restrictions
• Misuse or interfere with the Platform or its services
Message Templates and Campaigns
You are solely responsible for:
• Message template content
• Broadcast campaigns
• Marketing communications
• Customer support messages
• Compliance of all communications with applicable laws and Meta policies
4. WhatsApp-Specific Terms
By using WhatsApp Business features within Edsans Reach, you acknowledge and agree that:
• WhatsApp messaging features are subject to Meta's terms, pricing, rate limits, and platform policies.
• Approval or rejection of message templates is determined solely by Meta.
• Meta may change, suspend, or discontinue APIs, pricing, features, or policies at any time.
• Opik Web Solutions is not responsible for Meta's service availability, API changes, pricing updates, delivery failures, account restrictions, or any actions taken by Meta regarding your WhatsApp Business Account.
• Message delivery depends on Meta's infrastructure, recipient availability, and compliance with Meta's policies and cannot be guaranteed.
5. Data & Privacy
Our collection, storage, and processing of information are governed by our Privacy Policy.
By using Edsans Reach, you consent to the collection and processing of your information as described in our Privacy Policy.
Users are responsible for ensuring that all customer data collected and processed through the Platform complies with applicable privacy and data protection laws.
6. Account Suspension and Termination
We reserve the right to suspend or terminate your account without prior notice if you:
• Violate these Terms of Service
• Violate Meta's WhatsApp Business policies
• Send spam or prohibited content
• Engage in fraudulent or unlawful activities
• Misuse the Platform
• Create security risks for the Platform or other users
Your access may also be suspended if Meta restricts or disables your WhatsApp Business Account or API access.
7. Limitation of Liability
To the fullest extent permitted by law:
• Opik Web Solutions shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of Edsans Reach.
• We do not guarantee uninterrupted, secure, or error-free operation of the Platform or WhatsApp Business services.
• We are not responsible for delivery failures, template rejections, account restrictions, API limitations, outages, or other issues caused by Meta or third-party providers.
• Our total liability for any claim relating to the Platform shall not exceed the amount paid by you for the Services during the twelve (12) months preceding the claim.
8. Intellectual Property
All software, trademarks, branding, documentation, designs, and content associated with Edsans Reach remain the exclusive property of Opik Web Solutions or its licensors.
You may not copy, reproduce, modify, distribute, reverse engineer, or create derivative works from any part of the Platform without prior written permission.
9. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services, legal requirements, or Meta's platform policies.
Updated Terms become effective immediately upon publication on this page. Continued use of the Platform constitutes acceptance of the revised Terms.
10. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of India.
Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in Dehradun, India.
